Kurz gesagt: Turnmates ist ein kostenloses Rundenspiel für entspanntes Spielen ohne Zeitdruck. Sei fair, wähle Namen und Bilder, die niemanden verletzen, und rechne damit, dass eine kleine App auch mal Pause macht. Der ausführliche Text steht darunter.
1. Geltungsbereich und Anbieter
Diese Nutzungsbedingungen regeln die Nutzung der App Turnmates und der zugehörigen Websites. Anbieter und dein Vertragspartner ist:

Mit der Nutzung der App stimmst du diesen Bedingungen zu. Wenn du damit nicht einverstanden bist, nutze die App bitte nicht.
2. Was Turnmates ist
Turnmates ist ein asynchrones Wortlegespiel: Du und deine Mitspielenden setzt abwechselnd Züge, wann immer es euch passt. Die Nutzung ist kostenlos. Es gibt keine Werbung, keine In-App-Käufe und keine Abonnements. Sollte sich das einmal ändern, informieren wir vorher und holen die nötigen Zustimmungen ein.
3. Dein Konto
Beim ersten Start legt die App automatisch ein anonymes Konto an. Du brauchst dafür weder E-Mail-Adresse noch Passwort. Was dabei gespeichert wird, steht in der Datenschutzerklärung.
- Das Konto ist an dein Gerät gebunden. Verlierst du den Zugriff auf das Gerät oder löschst die App, können deine Partien unwiederbringlich verloren gehen — wir können ein anonymes Konto nicht wiederherstellen.
- Du bist dafür verantwortlich, was über dein Konto geschieht.
- Ein Anspruch auf ein Konto oder auf einen bestimmten Anzeigenamen besteht nicht.
4. Fair spielen — Regeln fürs Miteinander
Turnmates soll ein entspannter Ort bleiben. Deshalb gilt: Anzeigename, Profilbild und alles andere, was für Mitspielende sichtbar ist, dürfen nicht
- beleidigend, diskriminierend, sexistisch, rassistisch oder extremistisch sein,
- gegen Gesetze verstoßen oder zu Straftaten aufrufen,
- Rechte Dritter verletzen (z. B. Urheber-, Marken- oder Persönlichkeitsrechte — benutze keine fremden Fotos ohne Erlaubnis),
- andere Personen belästigen, bedrohen oder gezielt bloßstellen,
- Werbung enthalten oder eine andere Person oder Organisation vortäuschen.
Außerdem nicht erlaubt: die App oder unsere Server automatisiert auszulesen, zu manipulieren oder zu überlasten, Sicherheitsmechanismen zu umgehen, Spielstände oder Züge auf technischem Weg zu fälschen oder die App zurückzuentwickeln, soweit das Gesetz das nicht ausdrücklich erlaubt.
Verstöße kannst du uns formlos an support@buddynetwork.de melden.
5. Inhalte, die du einstellst
Anzeigename und Profilbild bleiben deine Inhalte. Du räumst uns nur das Recht ein, sie im Rahmen der App zu speichern, technisch aufzubereiten (z. B. zu skalieren) und deinen Mitspielenden anzuzeigen — mehr brauchen wir nicht, und mehr nehmen wir uns nicht. Du sicherst zu, dass du die dafür nötigen Rechte hast.
6. Verfügbarkeit
Wir geben uns Mühe, dass Turnmates läuft — aber wir schulden keine bestimmte Verfügbarkeit. Wartungsarbeiten, Störungen bei unseren Dienstleistern, Updates von iOS oder schlicht das Ende dieses Projekts können dazu führen, dass die App zeitweise oder dauerhaft nicht nutzbar ist.
Wir dürfen die App jederzeit ändern, Funktionen ergänzen oder entfernen und den Dienst insgesamt einstellen. Eine geplante Einstellung kündigen wir mit angemessener Frist in der App oder auf dieser Website an, damit du dich darauf einstellen kannst. Da die Nutzung kostenlos ist, entsteht dir dadurch kein finanzieller Schaden.
7. Beendigung
Du kannst die Nutzung jederzeit beenden: App löschen oder Konto in der App löschen. Auf Wunsch löschen wir dein Konto auch nach einer formlosen E-Mail (siehe Datenschutzerklärung).
Wir dürfen ein Konto sperren oder löschen, wenn du erheblich oder wiederholt gegen Abschnitt 4 verstößt oder wenn das gesetzlich geboten ist. Bei weniger schwerwiegenden Verstößen weisen wir dich vorher darauf hin, soweit das zumutbar und möglich ist. Laufende Partien können dabei beendet werden.
8. Haftung
Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei der Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz und im Rahmen übernommener Garantien.
Bei einfacher Fahrlässigkeit haften wir nur für die Verletzung wesentlicher Vertragspflichten — also solcher Pflichten, deren Erfüllung die ordnungsgemäße Nutzung der App überhaupt erst ermöglicht und auf deren Einhaltung du regelmäßig vertrauen darfst — und dabei begrenzt auf den bei Vertragsschluss typischerweise vorhersehbaren Schaden. Im Übrigen ist unsere Haftung ausgeschlossen.
Für das Verhalten anderer Nutzerinnen und Nutzer und für die Inhalte, die sie einstellen, sind diese selbst verantwortlich.
9. Datenschutz
Welche Daten wir verarbeiten und warum, steht in der Datenschutzerklärung. Sie ist nicht Teil dieser Nutzungsbedingungen, sondern erfüllt eine eigene gesetzliche Informationspflicht.
10. Änderungen dieser Bedingungen
Wir können diese Nutzungsbedingungen ändern, etwa wenn sich die App, unsere Dienstleister oder die Rechtslage ändern. Über wesentliche Änderungen informieren wir dich rechtzeitig vorher in der App. Widersprichst du nicht und nutzt die App weiter, gelten die geänderten Bedingungen. Andernfalls kannst du die Nutzung jederzeit beenden (Abschnitt 7).
11. Anwendbares Recht, Schlussbestimmungen
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Wenn du Verbraucherin oder Verbraucher mit gewöhnlichem Aufenthalt in einem anderen Staat der EU bist, bleiben die zwingenden Verbraucherschutzvorschriften deines Aufenthaltsstaats unberührt.
Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen (§ 36 VSBG).
Sollte eine Bestimmung dieser Bedingungen unwirksam sein, bleiben die übrigen Bestimmungen wirksam.
12. Hinweis zum App Store
Der Vertrag über die Nutzung von Turnmates kommt ausschließlich zwischen dir und uns zustande, nicht mit Apple. Apple ist weder für die App noch für ihre Inhalte verantwortlich und übernimmt keinen Support. Für die App gelten zusätzlich die Nutzungsbedingungen des App Stores. Die Altersfreigabe entnimmst du der Angabe im App Store; nutze die App bitte nur, wenn du diese Altersgrenze erreicht hast.

In short: Turnmates is a free turn-based game for relaxed play without time pressure. Be fair, choose names and pictures that do not hurt anyone, and expect that a small app may occasionally take a break. The detailed text follows below.
1. Scope and provider
These terms of use govern the use of the Turnmates app and the associated websites. The provider and your contractual partner is:

By using the app you agree to these terms. If you do not agree with them, please do not use the app.
2. What Turnmates is
Turnmates is an asynchronous word game: you and the people you play with take turns whenever it suits you. Use of the app is free of charge. There is no advertising, there are no in-app purchases and no subscriptions. Should this ever change, we will inform you in advance and obtain the necessary consents.
3. Your account
On first launch, the app automatically creates an anonymous account. You need neither an email address nor a password for this. What is stored in the process is set out in the Privacy Policy.
- The account is tied to your device. If you lose access to the device or delete the app, your games may be lost irretrievably — we cannot restore an anonymous account.
- You are responsible for what happens via your account.
- There is no entitlement to an account or to any particular display name.
4. Playing fair — rules for playing together
Turnmates is meant to remain a relaxed place. Therefore your display name, profile picture and everything else visible to the people you play with must not
- be insulting, discriminatory, sexist, racist or extremist,
- violate the law or call for criminal offences,
- infringe the rights of third parties (e.g. copyright, trademark or personality rights — do not use other people's photos without permission),
- harass, threaten or deliberately expose other persons,
- contain advertising or impersonate another person or organisation.
Also not permitted: reading out, manipulating or overloading the app or our servers by automated means, circumventing security mechanisms, falsifying game states or moves by technical means, or reverse engineering the app except where the law expressly permits this.
You can report violations to us informally at support@buddynetwork.de.
5. Content you provide
Your display name and profile picture remain your content. You merely grant us the right to store it within the app, process it technically (e.g. to scale it) and display it to the people you play with — we need no more than that, and we take no more than that. You warrant that you hold the rights required for this.
6. Availability
We do our best to keep Turnmates running — but we owe no particular level of availability. Maintenance work, disruptions at our service providers, iOS updates or simply the end of this project may result in the app being temporarily or permanently unusable.
We may change the app at any time, add or remove features and discontinue the service altogether. We will announce a planned discontinuation with reasonable notice in the app or on this website so that you can prepare for it. As use is free of charge, you do not incur any financial loss as a result.
7. Termination
You can stop using the app at any time: delete the app or delete your account in the app. On request we will also delete your account following an informal email (see the Privacy Policy).
We may block or delete an account if you seriously or repeatedly violate section 4 or if this is required by law. In the case of less serious violations we will notify you beforehand, insofar as this is reasonable and possible. Ongoing games may be terminated in the process.
8. Liability
We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, as well as under the German Product Liability Act and within the scope of guarantees we have assumed.
In cases of ordinary negligence we are liable only for the breach of material contractual obligations — that is, obligations whose fulfilment makes the proper use of the app possible in the first place and on whose observance you may regularly rely — and then limited to the damage typically foreseeable at the time the contract was concluded. Any further liability is excluded.
Other users are themselves responsible for their conduct and for the content they provide.
9. Data protection
Which data we process and why is set out in the Privacy Policy. It does not form part of these terms of use but fulfils a separate statutory information obligation.
10. Changes to these terms
We may amend these terms of use, for example if the app, our service providers or the legal situation change. We will inform you of material changes in the app in good time in advance. If you do not object and continue to use the app, the amended terms apply. Otherwise you may stop using the app at any time (section 7).
11. Applicable law, final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another EU member state, the mandatory consumer protection provisions of your state of residence remain unaffected.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
Should any provision of these terms be invalid, the remaining provisions shall remain effective.
12. Note regarding the App Store
The contract for the use of Turnmates is concluded exclusively between you and us, not with Apple. Apple is responsible neither for the app nor for its content and provides no support. The App Store terms of service apply to the app in addition. Please refer to the App Store for the age rating; only use the app if you have reached that age.
